§ 3 General legal bases

For processing of personal data necessary for theperformance of a contractto which the data subject is a party, Article 6 (1) (b) of the GDPR serves as the legal basis. This also applies to processing operations required to carry outpre-contractual measures.
If processing is necessary to safeguard thelegitimate interestsof our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not prevail over the former interest, Article 6 (1) (f) of the GDPR serves as the legal basis for said processing. This is particularly the case if we use tracking to optimize the website or to measure the reach of our newsletter, as well as for direct marketing.
If the processing of personal data is required to fulfill a legal obligation to which our company is subject, Article 6 (1) (c) of the GDPR serves as the legal basis.
In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6 (1) (d) of the GDPR serves as the legal basis.

Insofar as we obtain the consent of the data subject for the processing of personal data, Article 6 (1) (a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.

Comprehensive rights:

  • according to Article 15 of the GDPR, you can request information about your personal data processed by us. In particular, you may request information regarding the purposes of processing, the category of personal data, the categories of recipients to whom your data are or have been disclosed, the planned retention period, the existence of a right to rectification, erasure, limitation of the processing, or revocation, the existence of a right to lodge a complaint, the origin of your data, if they were not collected by us, as well as the existence of an automated decision-making processing including profiling and potentially meaningful information about their details;
  • according to Article 16 of the GDPR you may request the immediate rectification of incorrect or incomplete personal data stored by us;
  • according to Article 17 of the GDPR, you may request the erasure of your personal data stored with us, unless processing is required to exercise the right of freedom of expression and information, fulfilment of a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • according to Article 18 of the GDPR, you may request the restriction of processing of your personal data, provided the accuracy of the personal data is contested by you, the processing is unlawful and you oppose the erasure of the personal data; we no longer need the data but they are required by you for the establishment, exercise or defence of legal claims or you have objected to processing pursuant to Article 21 of the GDPR;
  • according to Article 20 of the GDPR, you may request to obtain the data you provided to us in a structured, prevalent and machine-readable format or to transfer your personal data to another controller;
  • according to Article 7 (3) of the GDPR, you may revoke your previously given consent at any time. Revoking consent has the consequence that we are no longer allowed to process the data, that was subject to this consent, in the future from the time of the withdrawal and
  • according to Article 77 of the GDPR you have the right to lodge a complaint with a supervisory authority. To do so, you can typically contact the supervisory authority of your habitual residence, place of work, or of our place of business.


Exceptions

There is no right to erasure if processing is required

  • to exercise the right of freedom of expression and information;
  • to fulfill a legal obligation that requires the processing in accordance with the law of the European Union or the Member States, which the responsible person is subject to, or to perform a task that is in the public interest or is carried out in exercising official authority, which was delegated to the responsible person;
  • for reasons of public interest in the area of public health in accordance with Article 9 (2) (h) and (i) as well as Article 9 (3) of the GDPR;
  • for archival purposes of public interest, scientific or historical research purposes or for statistical purposes in accordance with Article 89 (1) of the GDPR, to the extent that the law referred to in section a) is likely to render impossible or seriously affect the achievement of the objectives of that processing, or
  • to assert, exercise or defend legal claims

§ 5 Website use

General data collected when the website is accessed

When using the website for informational purposes only, meaning without registering or otherwise transmitting information to us, we only collect the personal data transmitted to our server by your browser. When browsing our website, we collect the following data we require for technical purposes to deliver our website and safeguard the stability and security of our website (the legal basis is Article 6 (1)(f) GDPR):

  • IP address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Contents of the request (specific page)
  • Access status /HTTP status code
  • respective data volume transferred
  • Website where the request originated
  • Browser
  • Operating system and its interface
  • Browser software language and version.


Log files

The storage in log files occurs to ensure the functionality of the website. Furthermore, these data serve the optimization of the website and to ensure the security of our information technology systems. In this context, the data are not analyzed for marketing purposes. Furthermore, these purposes constitute our legitimate interest in data processing according to Article 6 (1f) of the GDPR.

The data will be erased as soon as they are no longer required for the purpose of their initial collection.

For data storage in log files, this is the case after no later than seven days. Storage beyond this time period is possible. In this case, the users' IP addresses are deleted or altered, which makes it impossible to associate the accessing Client.


Cookies

In addition to the above data, cookies are saved to your computer when using our website. Cookies are small text files on your hard drive which are stored in association with the browser you are using, and which deliver specific information to the entity that places the cookie (in this case, us). Google Analytics

The request includes sending the IP address and possible additional data required for reCAPTCHA to Google. For this purpose, the entry is transmitted to Google and subject to further processing there. By using reCaptcha you agree that your provided recognition contributes to the digitalization of old literary works. If IP anonymization is activated on this website, your IP address is first truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. The complete IP address is only transmitted to a Google sever in the USA, as well as stored and truncated there in exceptional cases.
